Article 53: GPAI Provider Obligations
Article 53 sets the baseline obligations for every provider of a general-purpose AI model: keep technical documentation per Annex XI, give downstream integrators information per Annex XII, run a copyright compliance policy, and publish a public training-content summary using the Commission's template. Open-source providers are exempt from the documentation and downstream-information duties, but not from the copyright policy or the training-data summary, and lose all exemptions once a model is classified as systemic risk.

- Draw up and keep up to date technical documentation per Annex XI, available to the AI Office and national authorities on request (Art. 53(1)(a)).
- Prepare and maintain information and documentation for downstream providers integrating the model, per Annex XII (Art. 53(1)(b)).
- Put in place a policy to comply with EU copyright law, including identifying and complying with rights reservations under Article 4(3) of Directive (EU) 2019/790 (Art. 53(1)(c)).
- Publish a sufficiently detailed, publicly available summary of training content, using the Commission/AI Office template (Art. 53(1)(d)).
- Cooperate with the Commission and national competent authorities (Art. 53(3)).
- Apply the open-source exemption from (a) and (b) only where the model is freely licensed with public parameters, weights, and architecture information, and only until the model is classified as systemic risk.

Open-source GPAI models are often assumed to be fully exempt from Article 53; they remain bound by the copyright-policy and training-data-summary duties, and lose every exemption the moment the model is classified as posing systemic risk.
Unsettled: The exact version identifier of the Commission's training-data-summary template, published 24 July 2025, was not verified in the underlying research.
